Moving to Dubai from the UK: a founder’s tax and business relocation plan

05 Jul, 2026

Moving to Dubai does not by itself end UK tax residence. Apply the Statutory Residence Test for the relevant UK tax year, assess any split-year treatment and review income or assets that remain connected to the UK. Your company needs a separate management and operating analysis. A UAE visa and company registration do not make a UK business, property portfolio or future sale tax-free. Obtain UK tax advice alongside UAE structuring advice before fixing the move date or changing ownership. (K1, K2, K3)

Who this applies to: UK-connected founders moving their household or business activity to the UAE, including owners who retain UK assets.

What does the UK residence test examine?

The Statutory Residence Test assesses automatic overseas tests, automatic UK tests and, where needed, sufficient ties. Work, homes, family, previous residence and UK days can affect the result. The UK tax year runs from 6 April to 5 April. (K1)

Do not use a generic maximum UK day count. Ask your adviser to calculate the relevant tests from your history and future arrangements. Maintain records of travel and UK workdays, not only flight dates.

For a move during 2026/27, assess the complete tax year and the years needed for the applicable test. Your first months in Dubai do not establish the full-year result.

Can the departure year receive split-year treatment?

Potentially, if a specific statutory case applies. Split-year treatment is not a choice available to everyone who moves mid-year. The detailed work, home, partner and following-year conditions can matter.

Even where split-year treatment applies, it does not remove all UK-source tax or every anti-avoidance rule. Ask the adviser which income falls in each part of the year and how to report the position. (K1)

What income and assets remain relevant?

Connection you retainQuestion for the UK adviser
UK rental propertyIncome tax, landlord withholding and reporting
UK property disposalNon-resident gains and disposal reporting
UK business or directorshipCompany residence, PE and remuneration
UK pensionPension type, domestic law and treaty treatment
Planned share sale or distributionTiming, residence and temporary non-residence
Estate and family assetsCurrent inheritance-tax residence rules

Do not group pensions into a claim that they are all taxed in the UK or all exempt after departure. Private and public-service pensions can have different treaty treatment. (K5)

How does UK property affect the plan?

A Dubai move does not remove UK taxation of UK property income. The Non-Resident Landlord Scheme concerns collection and withholding; approval to receive rent gross does not mean the rent is tax-exempt. (K6)

Selling UK property needs a non-resident capital-gains and reporting assessment. Non-residents generally must report UK property or land disposals within 60 days of completion, even if no tax is payable. Confirm the payment and any separate return obligations before completion. Keep the acquisition, improvement, valuation and disposal records. (K7)

What changes for inheritance tax after April 2025?

Do not rely on the old statement that inheritance tax only follows domicile. From 6 April 2025, the UK’s rules for overseas assets use a long-term UK residence framework. Prior residence and the years after departure can remain relevant.

An immediate move does not necessarily remove overseas assets from inheritance-tax exposure. Obtain estate advice before changing ownership or relying on a succession structure. (K4)

Can you move the business at the same time?

Assess each entity separately. A UK company does not become a UAE company because its shareholder moves. A UAE company can raise UK residence questions if people exercise central management and control in the UK. (K3)

Map staff, premises, contract authority and significant decisions. Record which business will perform the work and invoice customers. Assess transfers of shares, IP, contracts and employees before implementing them.

For continuing operations across borders, see running a Dubai company while living in Europe.

Which UAE work should run alongside the tax advice?

Choose the relevant immigration route and confirm the actual conditions. A company is not necessary for every residence route. Do not assume a property purchase or incorporation automatically qualifies you for a particular visa.

Select the licensed activity and operating location for the business. Prepare the bank application with ownership, activity and funding evidence. Plan accommodation, health insurance, schooling and practical household costs without treating them as tax evidence on their own.

Apply UAE corporate-tax and VAT rules to the actual activity. If a free zone is relevant, assess QFZP eligibility. (U1, U4)

What if you return to the UK?

Temporary non-residence rules can bring specified gains and income into UK tax on return where their conditions apply. Do not assume a short overseas absence makes a business sale permanently tax-free. (K2)

The foreign income and gains regime introduced from 6 April 2025 concerns qualifying arrivals or returns. It is not a general departure exemption. Have your adviser review a return before changing the plan. (K8)

What should you do first?

  1. Ask a UK tax adviser to assess residence and the intended departure year.
  2. List retained UK income, assets and business roles.
  3. Review any sale, distribution or estate decision before departure.
  4. Define the UAE household and immigration arrangements.
  5. Map company management, staff and customer operations.
  6. Agree the UK reporting route and UAE compliance work.
  7. Keep evidence and reassess before a return.

Use HMRC’s departure process appropriate to your filing position. P85 and Self Assessment have different roles. Filing a notification does not itself decide residence. (K9)
