France-UAE tax treaty: what it changes and what it does not

30 Apr, 2026

The France-UAE tax treaty can reduce double taxation, but it does not automatically end French tax residence or French taxation of French-source income. Establish your personal residence first. Then assess the company, each type of income and the treaty conditions. A UAE residence visa, free-zone company or Tax Residency Certificate does not settle all these questions. For a founder, the location of family, work and business decisions can matter as much as the incorporation address. Obtain French tax advice before a move, distribution or business sale. (F1, F2)

Who this applies to: French-connected founders and shareholders assessing treaty relief, income flows or continuing business exposure after a UAE move.

Does moving to Dubai end French tax residence?

Not by itself. French domestic residence rules examine the household or principal place of stay, professional activity and centre of economic interests. A day count alone is not a complete answer. (F2)

If both countries treat you as resident, treaty Article 4 contains the individual tie-breaker: permanent home, centre of vital interests, habitual abode, nationality and, where needed, competent-authority agreement. The sequence matters. Do not select whichever factor gives the preferred result. (F1, Article 4)

For the practical move and evidence plan, see how to establish UAE tax residency.

Can France still tax a UAE company?

A company and its shareholder need separate residence analyses. The treaty’s company-residence provision refers to the place of effective management where the company is resident in both states. Operating through a UAE company while making the significant decisions in France needs French advice. (F1, Article 4(3))

A French office, business presence or dependent contracting activity can also create a permanent-establishment question. Article 4 A defines permanent establishment. Article 6 addresses business profits and attribution. The outcome depends on the activity and facts, not the nationality printed on an invoice. (F1)

Which income needs a separate treaty check?

Income or eventWhat to establishTreaty provisions to review
French property rentProperty location and income ownerArticle 5
Business profitsEnterprise residence, PE and attributed profitArticles 4 A and 6
DividendsTreaty residence, beneficial owner and exceptionsArticle 8
Interest or royaltiesBeneficial owner, connected PE and payment termsArticles 9 and 10
Share or property disposalAsset type and specific taxing rightsArticle 11
Salary or directors’ feesWork location and payment categoryArticles 13 and 14

The treaty does not apply one general rate to all income. Domestic law and treaty relief must be assessed together.

Are French dividends automatically subject to zero withholding?

No automatic entitlement follows from opening a UAE company. Article 8(1) provides residence-state-only taxation of qualifying dividends when the recipient is the beneficial owner. The company paying the dividend remains subject to tax on its own profits. Article 8 also contains exceptions, including shares effectively connected with a PE or fixed base. (F1)

Do not apply a dividend-rate table from another treaty. The France-UAE rule needs its own residence, beneficial-ownership and exception assessment.

Review residence evidence, beneficial ownership, the treaty’s anti-abuse provisions and the payment or refund procedure. Ask the French adviser to confirm the result before payment. A holding company inserted only to obtain treaty relief requires particular care. (F1, “Droit aux avantages de la convention”, MLI Article 7)

Does the treaty remove French exit tax?

Do not assume it does. Exit tax arises under French domestic law when the departure and holdings meet the relevant conditions. Unrealised share gains and certain deferred gains can require analysis. Payment deferral, security, reporting and later events have separate rules. (F3)

Ask the French adviser to assess the intended departure year, the ownership history, values and any planned sale. Do not assume that departure to the UAE automatically grants or denies payment deferral. Confirm the applicable rules and the required procedure before leaving.

How do you prevent a treaty claim from depending on paperwork alone?

Keep evidence of the real facts: accommodation, travel, work, family arrangements, board authority, contracts and income ownership. A residence certificate should support a consistent account of where you live and where the company operates.

Article 19(2) also preserves French taxation in specified cases involving French domestic fiscal domicile or certain French-controlled entities, notwithstanding other treaty provisions. Its conditions, credit mechanism and exception for UAE citizens require specialist analysis. Do not assume that a treaty tie-breaker defeats this clause. (F1, Article 19(2))

Article 18(6) preserves specified French anti-avoidance powers. The consolidated treaty also includes a principal-purpose test through the multilateral convention. A residence certificate does not override these provisions. (F1, Article 18(6); “Droit aux avantages de la convention”, MLI Article 7)

What changes on the UAE side?

Ordinary personal salary is not subject to UAE personal income tax. Business activity, corporate income and VAT need their own analysis. If a company is relevant, use the QFZP eligibility guide rather than assuming a free-zone licence produces 0% tax. (U1, U4, U10)

Questions French founders ask

The treaty can allocate taxing rights and provide relief in eligible situations. It does not make worldwide income tax disappear for a French resident. Assess the specific income.

It does not remove France's taxing rights over French immovable property income. Apply the relevant domestic and treaty provisions.

Yes, for French residence, exit tax, withholding, retained assets and company-management exposure. UAE structuring advice does not replace it.
