UAE Tax Residency Certificate for business owners

28 Oct, 2026

A UAE business owner may obtain a Tax Residency Certificate when the applicable residence conditions and evidence requirements are met. Company ownership and a residence visa do not establish eligibility on their own. The Federal Tax Authority assesses the application for the relevant period and purpose, including whether a double taxation agreement applies. Begin with the FTA’s current certificate service.

What a UAE Tax Residency Certificate establishes

A Tax Residency Certificate, or TRC, records the FTA's certification of the applicant's tax residence for a specified period and purpose. It does not create the underlying facts of residence.

The FTA's tax residence guide explains these concepts. A shareholder's personal position also needs to be distinguished from the company's position. A company certificate is not a personal certificate for its owner.

Who this guide is for

This guide covers individual founders, shareholders and entrepreneurs preparing a UAE certificate application, including people moving from another country. It also explains the separate file needed when a UAE company is the applicant.

Before collecting documents, ask whoever needs the certificate what they require: the individual or company named, the period covered, the intended country and whether a foreign form needs attestation. A bank request, a foreign tax enquiry and a treaty claim may require different evidence.

How a business owner can meet UAE tax residence conditions

For individuals applying under UAE domestic rules, there are three alternative residence tests. The day counts are measured over a relevant consecutive 12-month period.

Domestic test
Conditions to assess
Domestic test
Presence of at least 183 days
Conditions to assess
Physical presence in the UAE for at least 183 days in the relevant period
Domestic test
Presence of at least 90 days with additional conditions
Conditions to assess
At least 90 days, plus UAE or GCC nationality or a valid UAE residence permit, and either a permanent UAE home or employment or business in the UAE
Domestic test
Usual residence and interests
Conditions to assess
Both the usual or primary place of residence and the centre of financial and personal interests are in the UAE

The FTA guide to tax residence explains the tests. The 90-day route has additional conditions; it is not a general rule that 90 days and a trade licence establish residence.

Ministerial Decision 27 of 2023 explains how time, home and interests are assessed. Parts of days generally count, and presence need not be consecutive. A permanent home must be continuously available, rather than merely occasional accommodation. Exceptional-circumstance rules can affect the count.

For an owner, prepare a dated account of where you lived, worked and made business decisions. Reconcile it with entry and exit records. If you rely on business activity, be ready to explain your role and the evidence supporting it.

Treaty certificates need a separate check

A certificate for a double taxation agreement, or DTA, must be assessed against that agreement's residence provisions. A domestic residence test is not a substitute for reading the relevant treaty. The FTA's current service card distinguishes DTA applications from certificates for other purposes and explains that additional treaty evidence may be needed.

Ask an adviser in the other jurisdiction to check the intended claim, the income concerned and any continuing filing obligations. Do this while planning the move, rather than waiting until a foreign tax authority asks for proof.

Documents for an individual applicant

Build the file around the test and purpose you are relying on. Some documents establish identity; others support the facts of residence.

The FTA service card sets different document requirements by test and purpose. Its August 2026 requirements take precedence over an older procedures manual where they differ. Use the current application checklist, rather than assuming that every applicant must supply the same number of bank statements or a particular type of lease.

Keep a short cover explanation showing how each document relates to the selected period. If you moved home or changed companies, explain the dates. A folder of current documents may not explain your position during the period being certified.

Documents for a company applicant

Company eligibility follows an entity test, rather than the individual day-count tests. A juridical person incorporated or otherwise formed or recognised in the UAE can be UAE tax resident under domestic rules. A foreign company may also be resident under applicable tax law where it is effectively managed and controlled in the UAE. A UAE branch should not be assumed to be a separate resident company. See the FTA guide, sections 5.1 and 6.1, then check any relevant treaty.

Prepare a separate company file. The current FTA checklist includes the licence, incorporation and constitutional documents, lease, the applicant's Corporate Tax TRN if available, signatory identity and authorisation, and effective-management evidence where applicable. See the company requirements on the FTA service card.

Also have relevant financial records, bank statements and audited accounts available if the application or authority requests them. Identify which entity earned the income or needs the certificate; a group structure should not be treated as a single applicant without checking the rules.

The FTA currently requires a company to have been established for at least 12 months before applying. That certificate application condition should be kept separate from the company's underlying residence analysis.

How to apply for a UAE Tax Residency Certificate

Confirm the applicant and purpose

Record the exact individual or legal entity, requested period, intended use and relevant country. Check eligibility before paying fees or requesting overseas treaty relief.

Prepare a consistent evidence file

Collect the relevant checklist documents and reconcile names, passport details, company records and dates. Explain gaps or changes rather than leaving the reviewer to infer them.

Enter through the official FTA channel

Use the FTA certificate service page to reach the current application channel. Its instructions use EmaraTax and the Tax Residency Certificate service. Select the correct applicant and certificate purpose. The owner's company TRN should not be used as though it were the individual's TRN.

Complete the submission and monitor requests

Upload the supporting file, pay the applicable charges and retain the submission reference. Respond to further questions with evidence that addresses the issue raised. If another jurisdiction requires a form, confirm that it covers the same country and period as the certificate request.

Check the issued certificate

After approval, verify the name, period and intended purpose before sending it to a bank, adviser or foreign authority. Keep the application evidence with the certificate so the record can be explained later.

Fees and processing time

The live FTA service card provides the applicable fees and estimated handling time. Check them at submission, particularly whether the applicant has their own Corporate Tax TRN and whether printed copies are required.

The FTA currently estimates 10 business days from receipt of a completed application. This is a service estimate, not a guarantee or the time needed to establish tax residence. Document requests and separate form-attestation or delivery steps can affect planning. FTA fees and service standards.

What a TRC does not resolve

A certificate does not automatically end residence or reporting obligations in another country. Nor does it establish entitlement to every treaty benefit for every type of income. A foreign claim may depend on the treaty, domestic law and facts beyond the existence of the certificate.

If you retain an overseas home, directorship, operating company or significant work activity, have those facts reviewed in that jurisdiction. Your UAE application and overseas advice should describe the same real situation.

A longer immigration permission, including a Golden Visa, does not replace this assessment.

Frequently asked questions

Company ownership alone does not determine your personal residence. Assess the applicable individual test and keep evidence for the relevant period.

An investor visa can be part of your immigration evidence, but the residence test and certificate requirements still need to be met.

Ownership is insufficient on its own. Check whether the individual meets an applicable domestic or treaty residence test, including any immigration-status condition attached to that test.

The term tax domicile certificate is often used for a tax-residence document. Check the FTA service requested and what the recipient needs, including person, purpose and period, rather than relying on the label.

The FTA currently requires a company applicant to have been established for at least 12 months. A personal application follows the individual's own eligibility and evidence; it is not the company's application.

Review your residence evidence

GCG can help assess the UAE side of your company and residence position and identify the evidence needed for the proposed application. Advice in your other country remains important where overseas tax obligations are involved. Book a consultation to discuss the applicant, intended use and relevant period.
